They may need someone to have the legal authority to make decisions on their behalf.<\/span><\/p>\n<p><span data-contrast=\"auto\">The law says that even if someone has a condition or disability in the list above, you cannot assume that they are not able to make their own decisions.<\/span><\/p>\n<p><span data-contrast=\"auto\">Before anyone can be granted the power to make decisions on someone else\u2019s behalf, it has to first be established how much the person is able to make and understand decisions.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b><span data-contrast=\"auto\">How does this apply to social care support?<\/span><\/b><\/h2>\n<p><span data-contrast=\"auto\">If someone needs support to help them live a good life, there are lots of decisions that have to be made about this.<\/span><\/p>\n<p><span data-contrast=\"auto\">If the person who needs support lacks Capacity (they are unable to make or understand decisions themselves), someone else will have to help them to make decisions, or make decisions for them.<\/span><\/p>\n<p><span data-contrast=\"auto\">There are two ways that a person can apply for legal authority to make decisions for someone else: Power of Attorney or Guardianship.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b><span data-contrast=\"auto\">Power of Attorney<\/span><\/b><\/h2>\n<p><span data-contrast=\"auto\">A Power of Attorney is a written document giving someone else the legal authority to make decisions on a person\u2019s behalf.<\/span><\/p>\n<p><span data-contrast=\"auto\">The person needs to have Capacity (be able to make and understand decisions at the moment) to apply for a Power of Attorney.<\/span><\/p>\n<p><span data-contrast=\"auto\">A Power of Attorney is usually used when someone thinks that their ability to make decisions may get worse in future. For example, this may be because of dementia or a worsening health condition.<\/span><\/p>\n<p><span data-contrast=\"auto\">A person has to be over 16 to apply for a Power of Attorney.<\/span><\/p>\n<p><span data-contrast=\"auto\">The Power of Attorney document lists the names of the people (known as attorneys) who the person wants to help them, and says what powers these people will have.<\/span><\/p>\n<p><span data-contrast=\"auto\">Most people do not think about the need to put Power of Attorney in place until something happens to their health that affects their ability to make decisions or to communicate.<\/span><\/p>\n<p><span data-contrast=\"auto\">But it can be helpful to apply for a Power of Attorney in advance, so the person has time to think through what they want.<\/span><\/p>\n<p><span data-contrast=\"auto\">A person needs to be able to make and understand decisions in order to apply for a Power of Attorney.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b><span data-contrast=\"auto\">Guardianship order<\/span><\/b><\/h2>\n<p><span data-contrast=\"auto\">If someone is unable to make and understand decisions (lacks Capacity), they will be unable to apply for a Power of Attorney.<\/span><\/p>\n<p><span data-contrast=\"auto\">In this case, another adult who wants to have the legal authority to make decisions for them has to apply for a Guardianship order.<\/span><\/p>\n<p><span data-contrast=\"auto\">Guardianship orders are most often used when a child who lacks capacity turns 16. Before they are 16, the child\u2019s parents usually have legal authority to make decisions on their behalf.<\/span><\/p>\n<p><span data-contrast=\"auto\">Parents need to apply for Guardianship in advance, in order to keep this legal authority after the child turns 16.<\/span><\/p>\n<p><span data-contrast=\"auto\">Guardianship orders may also be used when someone\u2019s ability to make and understand decisions has gotten worse, before a Power of Attorney was able to be put in place.<\/span><\/p>\n<p><span data-contrast=\"auto\">There are two type of Guardianship orders:<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"31\" data-list-defn-props=\"{&quot;335552541&quot;:1,&quot;335559685&quot;:720,&quot;335559991&quot;:360,&quot;469769226&quot;:&quot;Symbol&quot;,&quot;469769242&quot;:[8226],&quot;469777803&quot;:&quot;left&quot;,&quot;469777804&quot;:&quot;\uf0b7&quot;,&quot;469777815&quot;:&quot;hybridMultilevel&quot;}\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"auto\">Welfare Guardianship, where you have the power to make decisions about the person\u2019s health and wellbeing<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"31\" data-list-defn-props=\"{&quot;335552541&quot;:1,&quot;335559685&quot;:720,&quot;335559991&quot;:360,&quot;469769226&quot;:&quot;Symbol&quot;,&quot;469769242&quot;:[8226],&quot;469777803&quot;:&quot;left&quot;,&quot;469777804&quot;:&quot;\uf0b7&quot;,&quot;469777815&quot;:&quot;hybridMultilevel&quot;}\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"auto\">Financial Guardianship, where you have the power to make decisions about the person\u2019s money.<\/span><\/li>\n<\/ul>\n<p><span data-contrast=\"auto\">You can only apply for Guardianship when someone has been assessed as lacking capacity.<\/span><\/p>\n<p><span data-contrast=\"auto\">It can take a long time for applications to be processed, so it is a good idea to plan ahead as much as possible.<\/span><\/p>\n<p><span data-contrast=\"auto\">Planning ahead is especially important if you are the parent of a child who lacks capacity.
